Get Rid Of laws Against Public Nudity.

If  Gay can get The government to give them the right to same sex marriage,and give them all the same privileges as a tradition  marriage couple has. Then nudist should  petition the government to remove all laws prevent the freedom of nudists practicing public nudity.   Nudity is natural, healthy,saves money and natural resources .        All of God's creature are nude,we come into the world nude,why is nudity forbidden.       This could be issue could be submitted as a civil rights issue to the supreme count.Does any one agree?

    We don't have enough political power to make that happen. The primary reason we lack political power is our reluctance to identify ourselves as naturists and demand our rights.

One of the things I pointed out the we have very little political clout because so few nudists will join a national rights group or political action committees, PAC's, to further our cause. If you agree with the premise of this thread and want to work on it in some small way, then you should join groups like AANR or TNS, or both. DesertRat, AANR Member.

    I have posted several links to petitions which could be signed to establish new clothing optional beaches. The response was close to nothing. How can we expect new rights for nudists when the nudists, themselves, don't express the desire to  receive these rights?

    I believe I should have the right to be nude in my house or on my property within reasonable expectations of privacy. I also think there should be areas set aside on public lands where one can expect to see others in the nude. By the same token, others should have the right not to see someone in the nude if they do not wish to do so. I don't believe someone should walk down the middle of Main St. without their clothes. Perhaps if we respect their rights, they will respect ours. I don't see how gay marriage has anything to do with this. Gays marrying has no effect on my rights.

    Lets take it one step at a time and just demand that a % of park areas be designated as nude use. If this got wide spread then our numbers would start to increase.

    Agree totally. If we can have right to carry laws I don't see the harm in having a section on a beach or nude campgrounds. Not hurting anyone.

Getting rid of all laws would be too controversial, but increasing nude areas is a good idea. Also possibly make it legal to be in your own yard, not visible to street, even if neighbors might see,

    Yeah I completely agree! Do you think that if we can get most people that are active on the site to do this we can get somewhere with this. Nude freedom would be great that would be healthy and open it open for Everyone that wanted to try to have the opportunity and most of all we wouldnt have to worry about be indecent as so called which all of us agree indecent is really decent anyway.

    It is my observation that for a number of reasons nudists in US lack to collective capacity to spur such a change. Its a bit like hearding cats. The British on the other hand have made incredible strides in that direction. There is a fundamental difference in the way nudism is approach in the US and Britain/Europe. National organizations in Europe much more focused on national legislative action than those innUS seem to be. All the folks including some here who have converted the term nudism to mean a sexual pre party dont help matter either.

I have always said that it is ridiculous that single men have to pay more or the same price as a couple but single women don't have to. My husband and I have had memberships to Resorts and I always say something. I was told that it was so there wasn't a sausage fest. My response was this isn't a sex resort this is a nudist resort and your #1 rule on your list of rules is no SEX. I agree we should have free places to go. I would as a woman or couple would go more. I also wish that it was more acceptable to be nude. Then I could fight more for it and not worry about loosing my career that I worked hard to build

    You have a vet valid point . However in the US nude = sex. Even my wife still thinks that way. It was the culture that we grew up in. As far as the single male paying more unfortunately what management told is a true statement because of a few dickhead that would violate the rules. A few examples a couple is having problems domestic violence type - one get a restraining order against the other. It a rule saying dont bother the other person. The rule is violated the one being protected is either dead or in the hospital but there was a rule do not contact them.

    Years ago I worked as a bouncer in a clubs , we set the cover charge. If a well dress group came to the club we may do ladies free and guys 5.00. on the other hand somebody want in that looks like they may start trouble it might have been 20.00 with a 2 drink min. one purpose of the cover was to screen rifraf.

    Now we look at resort policies yes they have a rule NO SEX in public and proper etiquette does that stop the dirtbag from harassing or trying something with you. No you may realize it happens at times , but what about someone new. The woman would feel uncomfortable and if a couple the man more than likely would be pissed. So the leave go on line review the place give it a terrible review because of one dickhead, it does not matter staff stopped it immediately. The bad review will hurt the resort.

    As a bouncer the best and worse thing we had going for us ws reputation. Our repetition was your are welcome to come party and have a great time however if you come to start trouble you would end up in one or or both places hospital or jail. We tried to diffuse all situation before it got to that. We did have troublemakers test us.

    A resort has to keep it reputation to stay in business. Is it right they have to take those measures NO but it is no right for dickheads to do what what they do

This could beissuecould besubmitted as a civil rights issue to the supreme count.Does any one agree?[/quote] In the US, the court has ruled on two separate occasions that nudity is not protected as free speech unless it is very carefully contextualized in artistic terms but there isn't any clear guidelines for what art means, and depending on what state you live in there may be several laws that make it very difficult to enjoy nudism or naturism except on private property with no public exposure or sight lines. Marriage rights are a completely different constitutional matter and the legal argument there had nothing to do with nudism or naturism but human rights and access to the same legal rights as a hetero couple. Whether you agree or not, there is no human rights based argument for nudism that the court will hear, it requires constitutional basis and the current court are heavily traditionalist and use biblical morality as a foundation for interpreting the constitution. Under that kind of intellectual perspective, nudism is not even remotely considerable. However, in many jurisdictions what is the main hurdle is bylaws and state law. The cases brought before the court were about public random nudity not clubs, camps, spaces, swims, beaches colonies, etc. In theory, private businesses and private groups can do as they like on their own property. In practice, liquor laws, health and safety, public morality laws and zoning and permitting as well as general laws forbidding all kinds of acts and practices are used to make running a nude business impossible. Changing city and state councils and legislative reforms initiated by voters can be more effective tools. Ultimately, the courts see nudism as a choice and therefore not a right. It took us 10 years and tens of thousands of dollars to get the ruling for our beach to be legal here in Toronto for example and this is a much more liberal and less restrictive regime here, there are no actual laws against nudity, just bylaws around decency and health but those are community determined therefore flexible and enforcement is rarely applied.

The primary reason we lack political power is our reluctance to identify ourselves as naturists and demand our rights.[/quote] It's going to be much more simple to choose places with few laws and vague laws, or thin resources and take over a town, county or state council and bring changes to zoning, bylaw, enforcement and permitting so the legal reasons for local authorities to stop, harass or police nudist organizations and spaces are removed or mitigated. The main issue is complaints from people who see, or think they see, or think they know there might be naked people around somewhere. Signage, careful privacy structures like fences, hedges, buildings and woods between a naturist space and roads, homes, etc. with a clear amount of property as a buffer, good rules and regulation, membership structure and regular liaison with local authorities so that they can get resolution or response without rolling out and into the space or spaces, as well as a not for profit aspect that gives back to the community in material terms are some ways to keep a space open and problem free. Some states have courts that ruled women cutting through a private yard to get to the street on the other side easier who saw the resident of the home naked deserved restitution because of indecent exposure, and this actually flies in the face of the jurisprudence in most places which holds that those who look inside houses should not be looking inside houses and if they do, the sights they see are easily avoided by not looking. In England there are two recent rulings that support nudism in the garden or the yard of the home as private and therefore not indecent. There have also been cameras set up on poles deliberately to get footage of nudists otherwise out of sight and because they were police and therefore civic property they were deemed to be the public eye...and this was used to try to shut down a nudist home hosting events. It may have done so, I don't remember that detail. These kinds of local bylaw and state laws take years and years even once a scotus ruling is in place, and as I said, there is no legal challenge the court will hear on this having ruled already against the speech argument. The point about power is not insignificant either, for example polygamy is practiced in Utah still even though it is illegal nationally. There is too much local power and support for very hardcore Mormon beliefs and influence for any federal attempt to change this practice to be effective or even wise.

    As I understand it nudity has been officially declared a "state of dress" and specificallynot"a statement." In practical terms, this means that as a state of dress and not a statement, it is not protected by the 1st Amendment. So, why is nudity permitted during such events as the World Naked Bike Ride, Gay Pride Parades, and other such things? Those events are forms of protest and demonstration, which are protected by the 1st Amendment. More importantly, cities and municipalities are concerned that if they prohibit nudity at or during such events, then it will provide fodder for a test-case in court. In such a situation, the court may very well rule that nudity is a statement and not merely a form of dress. If the trial court does find that nudity is a statement, then nudity can no longer be prohibited within the jurisdiction of that court. That would embolden others to try being nude in other jurisdictions for the sake of creating test cases in other jurisdictions. Regardless of the decision of the lower (trial) court, it will most certainly be appealed -- by one side of the other. Although it's illegal to venue shop, nothing stops you from intentionally pushing the boundaries in a jurisdiction where you believe your case will receive a favorable decision. Appeals, naturally, end at the Supreme Court. If SCOTUS says nudity is an expression, then there go all of the anti-nudity laws all across the country. Few cities and states want this. The best way to prevent this from happening is to allow nudity during protests, demonstrations, and parades. Just conjecturing here, but perhaps an avenue of attack would be to have entrants in city parades promoting issues along the lines of World Naked Bike Ride or as some other form of protest or demonstration. Very likely, the parade organizers would refuse to allow that entrant into the parade. And that would be OK because it would provide standing for a court case.

    Religious Discrimination and the Law Another line of attack against anti-nudity laws might be from the religious perspective. I'm a barefooter. In situations where I've been told I had to don shoes -- where shoes (or lack thereof) were truly not a real issue, I have intoned the magical incantation: [em]My sincerely held religious beliefs prohibit me from wearing shoes[/em]. I have only used that on rare occasions. I doesn't always work. To fight it when it doesn't work would take a lot of time and effort. In such cases, I simply stop spending my money in those places. I'm sure they think they've won, but I quit spending my money there and tell others to do the same. I wonder whether anyone has ever tried that for nudity.
