The topic was in the news again today. I personally think this is an issue that the government need not get into and my suggestion is that if you have a penis, you use the men's. All of us have nipples, all of us have areolas, and some of us have breasts as well as a penis. With the design of most U.S. restrooms, privacy is not an issue because of individual stalls with doors. Any other thoughts?

[em][strong]The problem is, you would not always know if a real woman was using the male restroom, because some trans genders are more beautiful than many of the real women you see in everyday life. Then again you have some men with breast implants and makeup, but are still quite clearly male, however much they try to hide their real gender.

The solution would be, for ugly ones to use male restrooms and pretty ones use female restrooms. This would avoid confusion with real women going into the men's room.[/strong][/em]

I realize that you are making an attempt at humor.

Real women frequently use the men's restroom when the line for the women's is too long. Attractiveness is certainly not the issue. The real issue is a law that requires a person to use the restroom that would be appropriate for the sex at birth, not the sex at the time and does not consider transformation. Another thought is that a transgendered person would not likely be shocked by the sight of a penis.

I just gotta go! I really don't care who's in the restroom, bathroom, toilet, WC - whatever you care to call it. For me it's not a social place. I just gotta go!

I doubt there are many laws regarding who uses which restroom, and obviously there is no enforcement if there were any. Those who propose various solutions to what up until now has been a non-problem never offer any suggestions about who should enforce their new rules. Should we have some government official at the door of each public restroom? If so, exactly what would he or she do? Would users have to show their birth certificate, or crotch, or perhaps some government issued certificate of gender? Would entry be barred if the proper documentation is not produced? This whole issue is incredibly stupid. Is this a big problem somewhere? Methinks that some people don't have enough to worry about.
The long-term solution would obviously be to retrofit, or if a new building, install multiple, separate stalls/rooms completely isolated from each other with lockable doors and available to anyone much like Porta-Potties outdoors. A more expensive alternative and space intensive, but would solve all the aforementioned problems. Who wants to share a restroom with anyone else anyway?
Ditto

"Maybe the real solution is to stop electing stupid lawmakers".

This has to be one of the most intelligent things I have ever seen written on this forum. It would solve so many problems if everyone on both sides of the political spectrum would follow this very sage advice.

    Thank you for your wisdom!
Maybe the real solution is to stop electing stupid lawmakers.
The big problem with that idea is, that is usually the only option on the ballot. You just have to try and choose the lesser of two evils, and even then it is a compromise.
This BS happens every time government tries to legislate morality. Government needs to stay out of bathrooms....unless they really got to go.
It is called vote winning, so they get the votes form people who think things like this are sin, so more they say against this the better chance they will get voted in.

Body shame, group pressure, group bravery, non-acceptance and little to no respect and understanding towards each other is the reason why this is even an issue. To me, there is no issue. People should get over it, just like racism, there is only one race, the human race!

I agree that this should not be an issue, but it is for too many of us. So my solution to this problem is simple. If you have a penis, use the men's. If the line for the women's is too long, use the men's.

Such as the country America has become. Not much if anything is fair and just for all. We are racked full of double standards.

Personally I don't care who uses which restroom as long as they are really using the restroom and not just creeping around in there. If you have to go then just go and leave. However the creeping around thing has been going on well before the Identity issue was ever a thing.

The original intent of this thread was to comment on the debate as to how to determine in an official capacity which room was the proper one for a transgendered person to use. It has nothing to do with identity or safety, but what physical attribute could be seen. There will always be those who will try to skirt the rules and there will always be predators. Should our society become more enlightened and make nude more normal, this would not be the problem the some people want to make it.

But sure, in terms of locker rooms it also has to do with physical attributes. I would personally say that trans people should be able to use the facilities they feel aligns with their gender, period. We're all nudists on this site, so seeing any sort of nudity shouldn't come as much of a surprise to us.

Whichever facility they use, they should look and play the part. If the male looks the part of female they should also sit during use so they don't stand out.
My opinion does not include p-k schools. They are well defined. If necessary for schools, a single use could be made available for any student. PE showers can create a whole different response.
Yes genuine trans people will be using the facilities purely because they need them. And that will be the vast majority. But there will be a lesser number who exploit the ability to enter, say, a womens restroom with the view of taking advantage and abusing the women in there. Would it still be possible to do that without allowing self identifying trans people to choose which they use? Of course, but it wouldnt be as easy.
As a father, safety is always on my mind, especially related to children. However, I think it's wrong to criminalize or to focus on labels or identities rather than specific behaviors. Predators come in all guises, and the ones who get away with the most heinous crimes typically slide under the radar under the guise of most respected and least predictable. That's why I follow my instincts and understand that a well-loved "Pastor Bob" is statistically more likely to prey on my sons than a 6'3" trans woman. However, it's even more plausible that both have positive mission, goodwill and love in their hearts, so I'll look for that more than paying attention to their color nail polish.
