Picture Privacy

I'm not sure where to mention this but this division of the forum, being about site upgrades and opinions, seems like a good one.  I noticed recently that someone's photo listed as friends only appeared in their activity feed.  It seems like if someone uploads a file as open and changes is to private rather than uploading it as private the photo is still viewable on their activity feed on their profile page.  Is this a minor coding error that can be fixed? Should people know about this when they upload?
