Indecent exposure help

Looking for some advice.........I've been summoned to appear for an arraignment pertaining to an early morning naked walk, and someone called the cops! I was alone, in an empty parking lot or so I thought. Anyway, has anyone had to go through this? Open to any input

    Unless the someone who you are looking for that experienced being cited for public nudity (or worse) is in the exact state and locality as you their experience won't matter. Every state, county, town, city, and village has unique laws. Thinking of laws, did you check out your jurisdictional laws on nudity before you started your walks?

    As a general rule, and I am saying this as a former California peace officer, a crime is not a crime unless all elements listed in the penal code are met to make it a crime. For example, in California, you can not be cited or arrested for indecent exposure unless the element of lude or lascivious behavior is committed along with the nudity. Every DA in the state has said that simple nudity does not meet the criteria of ludeness or lasciviousness to fulfill the elements of the crime. If someone has an erection, or they are fondeling themselves, then that meets the criteria. Simple nudity does not but again, what state are you in?

    I'm in Washington State, and the statute states "intentionally makes any open and obscene exposure of his or her person or the person of another knowing that such conduct is likely to cause reasonable affront or alarm."

    In my area in Illinois it's a sex crime unless under extreme situation like rape, your on fire or your house is on fire or accidentally rip your clothes. Shoot even skinny dipping is illegal and the Chicago bike ride always hits legal road blocks each year. It kinda strange because when my mother was a kid skinny dipping and mooning people was just seen as fun

    I would definitely explore the definition of what is obscene by state statue. Is mere non-sexual nudity obscene? Do art text books in Washington high schools show the works of Van Gogh and other classic artists? There are even paintings of nudes in many state capitol grounds. Do your homework.     Also, as I read the statue as you posted it, it reads - knowing such conduct - which means one of the elements of this crime is having intent. If you did not have intent to expose yourself with the purpose of offending someone, that element of the crime is missing and falls on its face.

    My advice is dont tell the cops you belong to Truenudists, if they ever check the groups you belong to they might get the impression that getting caught nude in public is a fetish of yours. It would be a slam dunk for a prosecution.

    During Covid I was charged with assault for rubbing my hand against someone's shoulder when I reached to get my umbrella. That was all. She had a record of reporting people on false charges and was apparently the victim of sexual abuse in her marriage. There are a lot of weirdos out there. My advices is: 1) don't say anything 2) get a lawyer and 3) let things drag out and die as there's apparently nothing substantial.

    Being a full time nudist, and with the understanding that what people wear on their parts is their business (with the exception of any jewelry which is worn inside an original-equipment orifice {that is factually a sex toy}), I don't knock people's taste in pubic adornment - in public. With the assumption that the reported nudist was hiking with some of his extraneous metal parts in place (see photos in profile), the offended person who reported him to the police may have considered his very obvious penis jewelry as somehow offensive or of a sexual nature.

    There is a presumption here that Washington State's population centers are generally more liberal regarding the laws which apply to simple nudism in public places. But by walking around nude with metal on genital, that type of jewelry does have a tendency to make the penis more pronounced, and in truth, can and will push the male parts upward, outward - even downward if they are weighted - from the pubic region. And whether this assumed-to-be-intentional augmentation of penile/scrotal size includes only momentum of the forward, upward or dangling kind, giving the body parts in question heightened visibility - or even further, if the wearer has donned multiple pieces of metallic jewelry, and with those added parts there is likely some attending noises produced by the, jingling and clinking and clanking together of the different metal attachments as the wearer walks or jogs - any unexpecting passerby will definitely take notice of the lack of clothes. To the surprised viewer (or listener), the additions to the man parts draw more attention to the hiker's nudity and brings forth the very likely misperception of lewd and lascivious conduct.

    If there are future walks taken, and I suggest that this situation warrants a serious re-assessment of one's choice in venue when seeking the health benefits of natural hikes, it would be wiser to leave the hardware at home. If you live in bear country and you're attempting to scare any bears away from the trail with the clang of your cock rings, maybe it is time to consider an investment in a set of bear bells instead.

    wildwilly........I take any and all help as well as criticism. I have always been the type of person that dangles on the edge of life so I appreciate what you're trying to say, and yes I do wear a cockring and am not ashamed of it nor apologize for it. And in this case, I entirely disagree with what ur saying!

    Update.........I had my arraignment, have a date set for the next stage, and plan on having either a public defender with me, or my own council. It seems that a public defender is determined by income level, which the court said they would send me a form to submit for that. Still waiting!! If anyone reading this in the State of Washington has some legal counsel resources, I'm all ears :)

Surely the judge/prosecution wold need to see some form of real evidence of it, and if not then how would that be viewed? You see using common sense, most everyday average people if naked in their own property grounds would put their hand(s) over their privates if it came to their attention they were being stalked.

    Its not though, thats why threads like this exist.

    Staying away from the view of those fuzz making people is the only way to protect yourself.

    Having a kink about wanting to be caught nude in public is not being a nudist. Why there are so many groups for this kink is what Ill never understand.

Open to any input[/quote] This is from your Washington State Legislation I found online.RCWs ] Title 9A ] Chapter 9A.88 ] Section 9A.88.010 Beginning of Chapter ] 9A.88.030 RCW 9A.88.010 Indecent exposure. (1) A person is guilty of indecent exposure if he or she intentionally makes any open and obscene exposure of his or her person or the person of another knowing that such conduct is likely to cause reasonable affront or alarm. The act of breastfeeding or expressing breast milk is not indecent exposure. (2)(a) Except as provided in (b) and (c) of this subsection, indecent exposure is a misdemeanor. (b) Indecent exposure is a gross misdemeanor on the first offense if the person exposes himself or herself to a person under the age of fourteen years. (c) Indecent exposure is a class C felony if the person has previously been convicted under this section or of a sex offense as defined in RCW 9.94A.030. [ 2003 c 53 92; 2001 c 88 2; 1990 c 3 904; 1987 c 277 1; 1975 1st ex.s. c 260 9A.88.010.]You didn't intentionally expose yourself to anybody, so as far as I see this is a case of Basic Nudity and someone being a bloody prude. Unless you were actually flashing said person and waving your penis at her with the intention of causing shock, then her having seen you is possibly an invasion of your privacy, even though you should not really have been naked in what you thought was a very quiet car park ! I understand for some the need to push certain boundaries is a thrill, but common sense has to prevail sometimes. According to the Legislation (1), other than just being naked, you have done NOTHING wrong, your nudity was not intentional to offend anyone, you were just testing your own boundaries. IF they are going to try and make more of this than needs be, then I would call her out on why she stood there watching you for as long as she did ! That becomes an invasion of your privacy, even if you were in a public place with no one around. From what you have stated, you don't meet most of the wording in this small part of legislation. I hope you are absolved of whatever they are trying to get you on and that basic nudity is nothing more than what it is !

As far as you knew, you were on a parking lot that was empty, you didn't see anyone else about, so you can't have exposed yourself to this person with the intention of causing affront or alarm. This is where the Laws in the USA need to be reformed or changed, it's a joke that someone seeing you from afar can be classed as you intentionally flashing your bits at them, when they were not even there.
